When a person is injured as a result of the failure of a professional (such as a doctor or nurse, or a hospital) to follow the standard of care, it's called professional negligence. Whether it occurs legally depends upon the standards in the local community. Negligence does not occur every time treatment is unsuccessful or a diagnosis is incorrect, but rather when the professional fails to follow the proper protocol (i.e., ordering the appropriate tests, failing to recognize observable symptoms, etc.). Generally, another professional must give sworn testimony that the standard of care has been breached.
